Introduction:

SpatioTrack mobile application is a property of SpatioWorld Technologies Private Limited, established under the laws of India, having its registered office at Row House No. 1, SNo. 22/8, near Dhotre Bldg, Balewadi, Pune, Maharashtra 411045.

SpatioWorld Technologies Private Limited recognizes the importance of maintaining your privacy. We value your privacy and appreciate your trust in us. This Privacy Policy sets out how SpatioWorld Technologies Private Limited uses and protects any information that you give SpatioWorld Technologies Private Limited when you use the SpatioTrack mobile application. SpatioWorld Technologies Private Limited is committed to ensuring that your privacy is protected. The SpatioTrack mobile application is a GPS-tracking app. The main purpose of the app is to track their phone location.

This Privacy Policy applies to current and former users of our SpatioTrack mobile application. By visiting and/or using the SpatioTrack, you agree to this Privacy Policy. SpatioWorld Technologies Private Limited may change this policy from time to time by updating this page. You should check this page from time to time to ensure that you are happy with any changes.

Definitions:

The terms “SpatioWorld”, “Company”, “we”, “us” and “our” refer to SpatioWorld Technologies Private Limited.

The term “SpatioTrack” refers to SpatioTrack mobile application.

The terms “you” and “your” refer to the user of the SpatioTrack.

The term “Group” means, with respect to any person, any entity that is controlled by such person, or any entity that controls such person, or any entity that is under common control with such person, whether directly or indirectly, or, in the case of a natural person, any Relative (as such term is defined in the Companies Act, 1956 and Companies Act, 2013 to the extent applicable) of such person.

The term “Services” refers to any services offered by SpatioWorld Technologies Private Limited on SpatioTrack mobile application.

The term “Policy” refers to this Privacy Policy.

Please read this Policy before using the SpatioTrack or submitting any personal information to SpatioTrack. This Policy is a part of and incorporated within, and is to be read along with, the Terms of Use https://spatiotrack.com/privacy-policy.

Information Collection and Use:

User-Provided Information:

The SpatioTrack obtains the information you provide when you download and register the SpatioTrack. Registration with us is optional. However, please keep in mind that you may not be able to use some of the features offered by SpatioTrack unless you register with us.

When you register with us and use the SpatioTrack, you generally provide (a) your name, email address, age, user name, password, and other registration information; (b) transaction-related information, such as when you make purchases, respond to any offers, or download or use applications from us; (c) information you provide us when you contact us for help; (d) credit card information for purchase and use of the SpatioTrack, and; (e) information you enter into our system when using the SpatioTrack, such as contact information and project management information.

We may also use the information you provided us to contact you from time to time to provide you with important information, required notices, and marketing promotions.

Automatically Collected Information:

In addition, the SpatioTrack may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile device’s unique device ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browsers you use, and information about the way you use the SpatioTrack.

Device Real-Time Location:

When you use the SpatioTrack, we use GPS technology (or other similar technology) to determine your current location. Location data is reported to the server where you can monitor it via your user account. We will not share your current location data with other users or partners.

If you do not want us to use your location for the purposes set forth above, you should turn off the location services for the SpatioTrack located in your account settings or in your mobile phone settings and/or within the SpatioTrack.

Third-Party Access to Information:

We will share your information with third parties only in the ways that are described in this privacy statement.

We may disclose User Provided and Automatically Collected Information:

as required by law, such as to comply with a subpoena or similar legal process;

when we believe in good faith that disclosure is necessary to protect our rights, your safety or the safety of others, investigate fraud, or respond to a government request;

with our trusted services providers who work on our behalf, do not have an independent use of the information we disclose to them, and have agreed to adhere to the rules set forth in this privacy statement.

if the business is involved in a merger, acquisition, or sale of all or a portion of its assets, you will be notified via email and/or a prominent notice on our Web site of any change in ownership or uses of this information, as well as any choices you may have regarding this information.

We will share information with third parties who perform services on our behalf:

We may share your information with our vendors, consultants, marketing partners, research firms, and other service providers or business partners, such as payment processing companies, to support our business. For example, your information may be shared with outside vendors to send you emails and messages or push notifications to your devices in relation to our Services, to help us analyze and improve the use of our Services, and to process and collect payments.

We may also use vendors for other projects, such as conducting surveys or organizing sweepstakes for us. Some vendors may be located outside of India.

We will share information with Advertisers and advertising networks:

We may work with third parties such as network advertisers to serve advertisements on the SpatioTrack and on third-party websites or other media (e.g., social networking platforms). These third parties may use cookies, JavaScript, web beacons (including clear GIFs), Flash LSOs, and other tracking technologies to measure the effectiveness of their ads and to personalize advertising content for you.

While you cannot opt out of advertising on the SpatioTrack, you may opt out of much interest-based advertising on third-party sites and through third-party ad networks (including DoubleClick Ad Exchange, Facebook Audience Network, and Google AdSense). Opting out means that you will no longer receive personalized ads from third parties ad networks from which you have opted out, which are based on your browsing information across multiple sites and online services.

We will share information with our business partners:

This includes a third party who provides us with various services. Our partners use the information we give them as described in their privacy policies.

While you place a request to order through SpatioTrack, your information is provided to us and to the vendors with whom you may choose to order. In order to facilitate your online order processing, we provide your information to that vendors in a similar manner as if you had made a goods/products/food order directly with the vendors. If you provide a mobile phone number, SpatioWorld Technologies Private Limited may send you text messages regarding the order’s delivery status.

We will share information with Other Users:

If you are a delivery partner, we may share your name, phone number, and/or profile picture (if applicable), and tracking details with other users to provide them with the Services.

We may share information if we think we have to in order to comply with the law or to protect ourselves:

We may also share it if a government agency or investigatory body or other companies assisting us, requests when we are:

Obligated under the applicable laws or in good faith to respond to court orders and processes; or

Detecting and preventing the actual or potential occurrence of identity theft, fraud, abuse of Services, and other illegal acts;

Responding to claims that an advertisement, posting, or other content violates the intellectual property rights of a third party;

Under a duty to disclose or share your personal data in order to enforce our Terms of Use and other agreements, policies or to protect the rights, property, or safety of the Company, our customers, or others, or in the event of a claim or dispute relating to your use of our Services. This includes exchanging information with other companies and organizations for the purposes of fraud detection and credit risk reduction.

We may share information for Internal Use or may share it with any successor to all or part of our business:

For example, if part of our business is sold we may give our customer list as part of that transaction. We may also share your information with any present or future member of our “Group” (as defined above) or affiliates for our internal business purposes

We may share your information for reasons not described in this policy:

We may share your information other than as described in this Policy if we notify you and you consent to the sharing. We will tell you before we do this.

Opt-out rights:

You can stop all collection of information by the SpatioTrack easily by uninstalling the SpatioTrack. You may use the standard uninstall processes as may be available as part of your mobile device or via the mobile application marketplace or network.

You can opt out of receiving our marketing emails. To stop receiving our promotional emails, please email (contact@spatioworld.com). It may take about 5 working days to process your request. Even if you opt out of getting marketing messages, we will still be sending you transactional messages through email and SMS about your purchases.

Data Retention Policy, Managing Your Information:

We will retain User Provided data for as long as you use the SpatioTrack and for a reasonable time thereafter. We will retain Automatically Collected information for up to 24 months and thereafter may store it in aggregate. If you would like us to delete User Provided Data that you have provided via the SpatioTrack, please contact us at contact@spatioworld.com and we will respond in a reasonable time. Please note that some or all of the User Provided Data may be required in order for the SpatioTrack to function properly.

Your Data Protection Rights Under General Data Protection Regulation (GDPR):

If you are a resident of the European Union (EU) and European Economic Area (EEA), you have certain data protection rights, covered by GDPR.

We aim to take reasonable steps to allow you to correct, amend, delete, or limit the use of your Personal Data.

If you wish to be informed what Personal Data we hold about you and if you want it to be removed from our systems, please email us at contact@spatioworld.com.

In certain circumstances, you have the following data protection rights:

  • the right to access, update or delete the information we have on you;
  • the right of rectification. You have the right to have your information rectified if that information is inaccurate or incomplete;
  • the right to object. You have the right to object to our processing of your Personal Data;
  • the right of restriction. You have the right to request that we restrict the processing of your personal information;
  • the right to data portability. You have the right to be provided with a copy of your Personal Data in a structured, machine-readable, and commonly used format;
  • the right to withdraw consent. You also have the right to withdraw your consent at any time when we rely on your consent to process your personal information;

Please note that we may ask you to verify your identity before responding to such requests. Please note, we may not able to provide Service without some necessary data.

Your Data Protection Rights under the California Privacy Protection Act (CalOPPA):

CalOPPA is the first state law in the nation to require commercial websites and online services to post a privacy policy. The law’s reach stretches well beyond California to require a person or company in the United States (and conceivable the world) that operates websites collecting personally identifiable information from California consumers to post a conspicuous privacy policy on its website stating exactly the information being collected and those individuals with whom it is being shared and to comply with this policy.

According to CalOPPA, we agree to the following:

  • users can visit our site anonymously;
  • our Policy link includes the word “Privacy Policy”, and can easily be found on the home page of our website;
  • users will be notified of any privacy policy changes on our SpatioTrack Privacy Policy Page;
  • users are able to change their personal information by emailing us at contact@spatioworld.com.

Our Policy on “Do Not Track” Signals:

We honor Do Not Track signals and do not track, plant cookies, or use advertising when a Do Not Track browser mechanism is in place. Do Not Track is a preference you can set in your web browser to inform websites that you do not want to be tracked.

You can enable or disable Do Not Track by visiting the Preferences or Settings page of your web browser.

Your Data Protection Rights under the California Consumer Privacy Act (CCPA):

If you are a California resident, you are entitled to learn what data we collect about you, ask to delete your data, and not to sell (share) it. To exercise your data protection rights, you can make certain requests and ask us:

To delete your personal information:

If you make this request, we will delete the personal information we hold about you as of the date of your request from our records and direct any service providers to do the same. In some cases, deletion may be accomplished through the de-identification of the information. If you choose to delete your personal information, you may not be able to use certain functions that require your personal information to operate.

To stop selling your personal information:

We don’t sell or rent your personal information to any third parties for any purpose. We do not sell your personal information for monetary consideration. However, under some circumstances, a transfer of personal information to a third party, or within our family of companies, without monetary consideration may be considered a “sale” under California law. You are the only owner of your Personal Data and can request disclosure or deletion at any time.

If you submit a request to stop selling your personal information, we will stop making such transfers.

Please note, if you ask us to delete or stop selling your data, it may impact your experience with us, and you may not be able to participate in certain programs or membership services that require the usage of your personal information to function. But in no circumstances, we will discriminate against you for exercising your rights.

Your data protection rights, described above, are covered by the CCPA, short for the California Consumer Privacy Act. To find out more, visit the official California Legislative Information website. The CCPA took effect on 01/01/2020.

Children’s Privacy:

We do not use the SpatioTrack to knowingly solicit data from or market to children under the age of 13. If a parent or guardian becomes aware that his or her child has provided us with information without their consent, he or she should contact us at contact@spatioworld.com. We will delete such information from our files within a reasonable time.

Security:

We are concerned about safeguarding the confidentiality of your information. We provide physical, electronic, and procedural safeguards to protect the information we process and maintain. For example, we limit access to this information to authorized employees and contractors who need to know that information in order to operate, develop or improve the SpatioTrack. Please be aware that, although we endeavor to provide reasonable security for the information we process and maintain, no security system can prevent all potential security breaches.

Changes to This Policy:

This Policy may be updated from time to time for any reason. We will notify you of any changes to our Policy by posting the new Policy here. You are advised to consult this Policy regularly for any changes, as continued use is deemed approval of all changes.

Your Consent:

By using the SpatioTrack, you are consenting to our processing of your information as set forth in this Privacy Policy now and as amended by us. “Processing” means using cookies on a computer/handheld device or using or touching information in any way, including, but not limited to, collecting, storing, deleting, using, combining, and disclosing information, all of which activities will take place in the United States. If you reside outside India your information will be transferred, processed, and stored there under India’s privacy standards. If you do not agree with the Policy, please do not use or access the SpatioTrack.

Jurisdiction:

If you choose to visit/use the SpatioTrack, your visit and any dispute over privacy are subject to this Policy and SpatioTrack’s terms of use. In addition to the foregoing, any disputes arising under this Policy shall be governed by the laws of India under Pune, Maharashtra jurisdiction of India.

Further, please note that the SpatioTrack stores your data with the Cloud Virtual Private Server service provided by Contabo GmbH,  Aschauer Straße 32a, 81549 München which may store this data on their servers located at Düsseldorf, Germany. Contabo GmbH has security measures in place to protect the loss, misuse and alteration of the information, details of which are available at Contabo GmbH’s Privacy Policy Page at https://contabo.com. The privacy policy adopted by are detailed in Privacy Policy | Contabo.
